Willy Mutunga Comes To CJ Maraga’s Rescue

Former Chief Justice Willy Mutunga has condemned Jubilee Secretary General Raphael Tuju following the latter’s protest letter to the Supreme court’s Chief Justice David Maraga.

Tuju on Wednesday took issue with CJ Maraga’s last years’ judgement which saw President Uhuru Kenyatta’s August 8 election voided.

Tuju accused Maraga and the judiciary of bias, citing examples of decisions that have worked in favor of National Super Alliance (NASA) coalition.

In his response to Tuju’s letter, former CJ Mutunga said the move was a show of “arrogance of power and utter disrespect of the institution of the chief justice as head of the judiciary”.

He said the former Rarieda MP showed disrespect to the Judicial Service Commission, the National Council on the Administration of Justice, and the NCLR.

“He could have filed the complaint with the JSC. I believe his aim was to intimidate CJ Maraga personally,” Mutunga said via Twitter on Thursday.

He said Tuju should have addressed his complaint to the Office of Judiciary which receives complaints against judicial officers.

The controversial letter appears to read from Uhuru’s initial threats after the the Supreme court voided his August 8th win where he warned that they “shall revisit” the conduct of the Judiciary.

The Jubilee Secretary General cited several cases, especially those related to the last year’s August 8 and October 26 presidential elections.

He said that the Judiciary has continued to act in impunity after the elections especially by giving ex parte orders.
