The petition by Martha Karua,lodged against Kirinyaga Governor Ann Waiguru will be heard afresh following the Court of Appeal’s ruling on Friday,2nd March.
Martha Karua, Waiguru’s opponent in the August 8 gubernatorial race,had moved to the Court of Appeal to challenge a High Court’s ruling that dismissed her petition.

On November 15, 2017,Lady Justice Lucy Gitari of Kerugoya High Court threw out her petition on grounds that it was fatally defective, hopeless and incurable.
The judge further explained that the Narc Kenya leader failed to comply with Election (Parliamentary and County) Petition Rules of 2017.
The court found that Karua omitted the disputed election results and dates declared by IEBC, which is a mandatory requirement.
The court said the former justice minister’s failure to comply with the election petition rules had consequences and was in violation of rights to fair trial.

Karua, through lawyer Gitobu Imanyara, moved to the Court of Appeal last year December to challenge the High Court’s decision.
Karua, in her appeal, said that Lady Justice Gitari was biased in the matter and applied double standards.
