Uhuru seeks to defend win as NASA joins petition at the last minute

President Uhuru Kenyatta is set to put up a spirited fight to demonstrate to the seven judges why they should not void his election for a second time, even as the opposition coalition (NASA) made a last-minute entry into the case.

NASA is accusing the Head of State and the electoral commission of engaging in electoral misconduct.

In an affidavit, NASA’s head of presidential campaign, Musalia Mudavadi, accuses the electoral body of frustrating all efforts made to hold its commissioners accountable for the bungled August 8 Presidential election.

Had the commission agreed to reconstitute itself, Mudavadi argues, the opposition coalition would have participated in the October 26th election.

“On October 10, 2017, after evaluating the atmosphere of violence and intimidation that had been created by the 3rd Respondent (Uhuru) and the failure of the 1st and 2nd Respondent, the IEBC and Chairman Wafula Chebukati, to meaningfully engage and implement reforms and changes the 4th Respondents (NASA) had suggested aimed at creating a level playing field for all the Presidential candidates, NASA resolved to withdraw its candidate from the Presidential race,” says Mudavadi,as quoted by The Star.

Mudavadi further says Kenyatta’s decision, through his acting Interior CS Fred Matiang’i,  to withdraw the security detail of the two NASA principals also formed the basis to quit the repeat poll.

“In response thereto, NASA commenced a series of voter education drives to inform its supporters that its candidates were not part of any exercise to be conducted on 26th October, 2017,” he said in the 15-page affidavit.

NASA also wants the Apex Court to take issue with Kenyatta’s statements following the nullification of the August 8 polls targeting the judges who annulled his August 8th win.

Upon receiving documents from all he parties yesterday, the Supreme court is expected to convene for a pre-trial conference on Tuesday to iron out issues that need to be determined,followed by the hearing.
