The two witnesses skipped a court session although they were duly bonded, the prosecution said while applying for the summons.
“We have the bonds duly signed by the witnesses committing to appear in court today. However, none is in court.” The prosecution told Senior Principal Magistrate, Joyce Boke.
“I ask the court to summon the said witnesses,” they added as quoted by Nairobi News.
In the case, Andrew Kenneth has denied causing a road accident at the junction of Waiyaki Way and Musa Gitau roads on January 11 2017, which left Kennedy Sijei Kachuan dead.
According to the charge sheet, Andrew Kenneth was driving a Lexus when he allegedly committed the accident.
The victim died on the spot, according to his widow, Esther Nduku, who testified last year.
She told the court that she received a call from the police informing her that her husband had been involved in a road accident at Waruku,Kangemi.
“I went to the scene and saw the body of my husband on the side of the road. There was a vehicle… police told me he was dead and they were searching for his leg,” Ms Nduku, a mother of three, told the court in her testimony.
The court heard that the deceased was waiting for traffic to clear so as to cross the road. Ms Nduku said that her husband had spent the night at their house in Kangemi.
The magistrate adjourned the case to October 23 when the summoned witnesses are expected in court.
