There Were Errors In Results Used to Declare Mutua Winner- IEBC Official admits

An Official of the Independent Electoral and Boundaries Commission (IEBC) on Friday (15th December) admitted in Machakos court that there were discrepancies in the results she used to declare Dr Alfred Mutua winner of August 8th Governor race

She however argued that the discrepancies could not affect the overall outcome.

“There were some discrepancies in the results entered in one or two forms and in others the presiding officers did not sign, but the variances could not significantly affect the overall outcome of the results.”Machakos county returning officer Joyce Wamalwa told the court.

Ms Wamalwa denied knowledge of some county officials having worked as presiding officers, saying she did not know all 1,332 presiding officers.

Petitioner’s lawyer Willis Otieno took the witness (Ms Wamalwa) to task when he demanded she explain why the Kangundo constituency returning officer announced results using forms 38A meant for the senatorial race.

He also inquired why the form used to announce the results for Machakos constituency, “lacked the commission’s serial number”.

A heated exchange ensued between the petitioner (Ndeti) and respondents’ lawyers when Ndeti’s Lawyer, Willis Otieno, sought to know from Ms Wamalwa whether the presiding officers who declared Yatta and Masinga constituencies were the ones gazetted by the IEBC.

Lawyer Willis Otieno said the results for Masinga were announced by one Lucy Mueni John, whereas the IEBC officer gazetted as the constituency returning officer was one Nicholus Karimi.

However, IEBC lawyer Kimani Muhoro was quick to interject, saying, despite the gazettement done by the electoral agency on May 5, some changes were made.

The case will resume on January 8 2018.
