Mr Bush and Chengo wanted the Apex court to allow them file the application without paying the mandatory Sh1.5 million court fees, arguingthey are poor and can’t afford to pay that amount.
They claimed that they live in a mud-walled house in Huruma and attached their Mpesa statements to show their financial status.
They argued that when NASA leaders Raila Odinga pulled out of the race, it affected the polls.
They also said the fact that there were no elections in 25 constituencies affected the outcome.
