Revealed:What Raila Had Initially Planned But Changed Tact at the Last Minute and Opted for the court

While the NASA leaders had consistently vowed they would not seek redress in court over the disputed presidential election, details have emerged that there were various conflicting interests that led to Wednesday’s decision by NASA leader Raila Odinga to go to court.

According to impeccable sources privy to The Standard Newspaper, a section of NASA leaders were pushing for mass action, because of frustrations NASA had encountered, including the refusal of the Independent Electoral and Boundaries Commission (IEBC) to allow them access to its servers to authenticate the results they were streaming on their portal.

However, some other NASA leaders cautioned about the repercussions of the peaceful demonstrations escalating into violent protests and the Jubilee government pinning the blame on them for any subsequent loss of lives.

This moderate group reportedly cited the death toll from the sporadic protests following the declaration of Uhuru Kenyatta as president-elect, arguing that if the use of excessive force by Police officers was anything to go by, mass action would be bloodier.

Other than the mounting pressure from the international community for NASA to petition their grievances in court, another development that forced their hand was the State crackdown on two human rights groups.

Raila’s brigade had hoped that either the Kenya Human Rights Commission (KHRC) or Africa Centre for Open Governance (AfriCOG) would independently petition the poll results so that they would ride on their case.

But Monday’s threat to close the two, followed by a police raid at AfriCOG offices, left NASA with no choice but to opt for the legal way.

Another source said NASA was prepared to peacefully settle the dispute were it not for the Chebukati’s adamant refusal to give in into their request.
