NASA leaders Raila Odinga and Kalonzo Musyoka face the risk of being jailed after top state agencies have been ordered by the Director of Public Prosecution (DPP) Keriako Tobiko to commence investigations against them.
The DPP directed the Director of Criminal Investigations (DCI) to launch investigations and possible prosecution of Mr Odinga and his deputy over their irrevocable stance of not participating in the upcoming election slated for October 26th.
This comes after a petition filed by Samuel Waweru through Harrison Kinayanjui & Co. Advocates.
In a letter addressed to DCI boss Ndegwa Muhoro,Tobiko said the opposition leader be investigated for contravening Section 132 of the Penal Code after the two vowed ‘there will be no election on October 26th’.

He also wants them probed for breach of Section13 (k)(i) of the Elections Act, 2016, and for contempt of the orders of the Supreme Court for fresh elections.
NASA has maintained it is ready for the fresh elections but will not participate until the electoral commission is revamped.
The leaders have also reiterated that they will not take part in the election unless Jubilee legislators withdraw their proposed amendments to the electoral laws.

Tobiko asked Muhoro to complete the investigations within 21 days for necessary steps to be taken.
“I call on the DCI to undertake thorough comprehensive and expenditure investigations.”
“I have also also designated a team of senior prosecutors to provide technical guidance and assistance to investigating teams,” Tobiko said as quoted by the Star.
