Matiang’i Suffers First Loss in Media Shutdown Petition

Interior Cabinet Secretary Fred Matiang’i and his fellow CS for Information Communication and Technology (ICT) , Joe Mucheru, suffered a major blow in the controversial media shutdown case after Nairobi High Court rejected their application seeking to expunge the contempt of court case lodged against them.

Judge Chacha Mwita rejected the prayer after Communication Authority (CA) sought to have the contempt of court application removed from the media shutdown case.

This is after Activist Okiya Omtatah moved to court on Monday seeking to have the two state officials brought to book for contempt of court after they disobeyed orders to restore signals of certain Media stations.

The outspoken activist also wanted Sam Iteere (PS ICT), Karanja Kibicho (PS Internal Security), Kamau Thuge (PS Treasury), CA directors including the Chairman of the board directors, Ben Ngene Gituku, be cited for contempt.

While issuing his ruling, Justice Mwita held his ground that respondents cannot be allowed to disobey court orders and choose when to comply with orders then come back to court in purport of full compliance.

“The court would want to hear the alleged technical hitches which resulted in noncompliance with the court orders”, he stated.

CA’s lawyer Wambua Kilonzo had submitted that the contempt of court order application by Okiya Omtata be set aside to allow the case on the switch off to be heard.
