Former President Mwai Kibaki has moved to Court seeking to regain ownership of a company he claims to have co-owned since the 70s.
Kibaki and his co-director Mr. Kimwangu Kanyutu want the Environmental and Land court ruling issued over the ownership of Mathingira Wholesalers Limited reversed.

Through senior lawyer Kamau Kuria,he also seeks to reverse the earlier directive that two sections continue to run the affairs of the company jointly.
They want the directors running Mathingira Wholesalers to be evicted , with control of the company given back to them.
Mr Kuria said the former president and Mr Kanyungu were not heard by Justice Lucy Waithaka, who issued the orders.
In the notice of motion, the lawyer said some parties in the suit, whose dispute started in 2008, died, and no substitutions were made.

He indicated that Justice Waithaka ignored the principle that equity follows the law.
The row started way back in 2007 when the company’s directors failed to agree on the firm’s management following the appointment of a new chairman.
