Judge Lenaola Speaks On Uhuru’s ‘revisit’ threats

Supreme Court Judge Isaac Lenaola has finally spoken about the attacks and threats by President Uhuru Kenyatta on the Supreme Court when it annulled his win on August 8.

Yesterday,Lenaola said the verbal attacks by the head of state, immediately after the annulment of the August 8 presidential election, undermine the courts’ independence.

Speaking during the ongoing East African Magistrates and Judges’ Association Conference in Kigali, Rwanda,Lenaola said a court’s decision should not please the system but the Constitution under which judges swore an oath on.

“Judicial independence in its widest sense is a precious pillar of any democracy. Its loss in any significant way portends the collapse of the democracy. We must guard it with all our might,” Justice Lenaola said as quoted by The Star.

His presentation was titled ‘Balancing Judicial Independence with Judicial Responsibility’.

President Uhuru Kenyatta launched a scathing attack on the Supreme Court judges after they revoked his win and threatened to ‘fix’ them after the electioneering period.

Mr Kenyatta called the judges ‘Wakora’(crooks) and accused them of attempting a ‘ judicial coup’.

The Apex court on Monday, however, in a unanimous decision, upheld Kenyatta’s win in the disputed October 26 fresh presidential poll.

The Kenyan delegates in the conference also includes Chief Justice David Maraga and Chief Registrar of the Judiciary Anne Amadi.
