The Independent Electoral and Boundaries Commission (IEBC) has responded to today’s ruling by Judge George Odunga at the Milimani High court.
According to Judge Odunga,the process that led to the appointment of constituency returning officers and their deputies is illegal,although the did not quash the gazette notice by the IEBC on the appointment of the officers.

In a swift rejoinder,The IEBC has maintained that the appointed Returning officers and their deputies will still oversee tomorrow’s election exercise .
“The appointed Returning Officers and their deputies will conduct the fresh presidential election on 26th October 2017.” said the IEBC on Twitter.
The IEBC argues that the Applicant sought for the cancellation of the appointment of the Returning Officers and their deputies,a prayer that was not granted by Judge Odunga.

“The order sought before Judge Odunga was cancellation of the Appointment of Returning Officers and Deputies,which has been declined.”
The embattled electoral body remained adamant that their appointments of the RO’s and their deputies was valid and would therefore use them in conducting tomorrow’s poll.
“The appointed Returning Officers and their deputies will conduct the fresh presidential election on 26th October 2017”
On October 12, the IEBC gazetted names of Returning Officers and their deputies to conduct Thursday’s poll.
Speaking to the press after the adjournment of the Supreme court hearing of a petition seeking to stop tomorrow’s poll,Senator James Orengo said the IEBC will be conducting an illegal exercise following Judge Odunga’s unprecedented ruling.
