Details The Supreme Court Registrar found On Forms 34A,Bs and Cs During Audit

After a tiresome three-day legal tussle between the NASA ,IEBC and Uhuru lawyers, the Supreme Court has retreated to look into the case and make a ruling that will most likely change the political landscape of Kenya for the next 5 years.

The seven judges are said to be in one of the Nairobi hotels looking into the petition. This comes after receiving a judiciary-commissioned audit, conducted by the court’s registrar,which indicated anomalies in at least 121 Forms 34B, used by IEBC chairman Wafula Chebukati to declare the President.

The report submitted before the court show at least 121 forms out of 291 scrutinized by the court contain vast anomalies.

According to the audit,conducted by Supreme Court Registrar Esther Nyaiyaki, 291 forms 34B — representing the 290 constituencies and the diaspora — were supervised by agents from both NASA and Jubilee.

Here are the anomalies that were found;

  1. 56 forms out of the 291 forms were not watermarked-a security feature that was part of the contract between Dubai based printer company Al Ghurair and the IEBC .
  2. Another 31 forms had no serial numbers,
  3. 5 forms were not signed by returning officers.
  4. Forms 34C had security features of watermark and serialization but looked like a photocopy.
  5. From 4,120 forms sampled across five counties; some were carbon copies, original form 34As did not bear the IEBC stamp, some forms were scanned copies and some forms not signed.
  6. 32 Forms 34B were not signed.

However the audit indicated that of the 291 forms,261 had serial numbers,while another 236 forms were watermarked.

At least 281 were signed by returning officers, 225 were signed and stamped by the ROs and two were only stamped. Some 260 forms were signed by agents.

NASA lawyer James Orengo termed the judiciary report “the smoking gun” and argued nearly five million votes were affected by the “erroneous” forms.

“Our case has been proved that forgery, alternation of documents fakery and deception have been used in various ways, including one in which the server was used,” Orengo told the court on Tuesday night.

The judges will deliver their ruling tomorrow at any time.

Their decision will either revoke Uhuru’s win or a rerun of the election will have to take place within 60 days.
