Court Bars IEBC from declaring Uhuru as president elect following Raila’s withdrawal

Activist Okiya Omtatah(pictured above) has obtained temporary orders barring the Electoral agency (IEBC) from declaring Uhuru Kenyatta the President-elect following the unprecedented decision by NASA leader Raila Odinga to withdraw from the October 26 poll.

In an application at the High Court, Mr Omtatah wanted the court to issue temporary orders restraining the IEBC from making the announcement after NASA candidate pulled out of the race.
In the ruling delivered Wednesday, October 11, the High Court answered his prayer.
“Pending the hearing and determination of this application and/or the petition herein the Honorable Court be pleased to issue a temporary order of injunction restraining the 1st and 2nd respondents, its agents, servants, or any person claiming to act under its authority from proceeding to announce President Uhuru Kenyatta as the president-elect following the withdrawal of the presidential and deputy presidential candidates representing the National Super Alliance,” the injunction read in part.
Lawyer Abdullahi Ahmednasir-who represented Uhuru at the Supreme court during Raila’s petition hearing- was among the many Kenyans who called on the IEBC to declare Kenyatta as the President-elect following Mr Odinga’s unexpected decision.
Raila’s decision to withdraw from the race has thrown a cloud of uncertainty on Kenyan politics as there is no clear law on the way forward.
The electoral body is yet to give the country on directions it will take.
In the meantime, the High Court has ruled that Thirdway Alliance’s Ekuru Aukot be allowed to contest in the repeat poll.
